Terms of Service

1. Agreement
By using SellPile, creating an account, starting checkout, buying credits, unlocking a plan, or using a paid result, you agree to these Terms, the Privacy Policy, and the Refund Policy. If you do not agree, do not use the service.
SellPile is operated by the SellPile business/operator identified in checkout receipts, account communications, or support replies. Contact: support@sellpile.app. You must keep your account email current so we can contact you about billing, support, legal, or security matters.
2. What SellPile provides
SellPile provides resale planning tools, item detection support, estimated resale price ranges, platform suggestions, listing drafts, photo enhancement, Rescue listing review, saved plans, credits, reminders, and related account features. SellPile is not a marketplace, broker, authenticator, appraiser, financial advisor, legal advisor, tax advisor, or buyer.
3. Your responsibility for listings
You are responsible for every listing you create, copy, publish, edit, or send to a marketplace. You must review all SellPile outputs before use, verify brand, size, condition, authenticity, model, working status, defects, shipping terms, and platform rules, and disclose relevant information honestly. Do not use SellPile output to mislead buyers or platforms.
4. AI and output limitations
SellPile uses automated and AI-assisted systems. Outputs may be incomplete, incorrect, outdated, unsuitable, or based on unclear photos or missing information. Price ranges, platform suggestions, sell/bundle/skip decisions, listing text, image enhancements, and Rescue reports are planning support only. They are not promises of sale, profit, authenticity, demand, legal compliance, or marketplace acceptance.
5. No sale or earnings promise
SellPile does not promise that any item will sell, that a buyer will pay a suggested price, that a marketplace will accept a listing, that an item is authentic, or that any user will earn money. Actual results depend on the item, condition, photos, demand, marketplace rules, buyer behavior, timing, shipping, and your own actions.
6. Account and eligibility
You must provide accurate account information, keep your account secure, and use SellPile only where lawful. You are responsible for activity on your account. SellPile may suspend or restrict accounts that appear abusive, fraudulent, unlawful, or harmful.
7. Credits, packs, and subscriptions
Paid packs and subscriptions grant the credits or access described at checkout. Credits are consumed when the requested paid result is successfully delivered, such as an unlocked item plan, a full Rescue report, or a completed photo enhancement. Failed AI calls should not consume credits. Credits have no cash value, are not transferable, are not redeemable for cash, and may be subject to abuse-prevention limits.
Unless the checkout page says otherwise, unused one-time pack credits may expire after 12 months of inactivity where permitted by law. Promotional, free, or bonus credits may expire earlier, may be changed or withdrawn, and have no refund value.
8. Payments and billing
Payments are processed by a third-party payment provider. Access is granted only after successful payment confirmation. Subscriptions, if offered, renew according to the checkout terms until cancelled. You are responsible for taxes, payment method validity, and any fees charged by payment providers or banks.
Before checkout for digital credits, plans, Rescue reports, or photo enhancement, you may be asked to confirm that you request immediate digital delivery and understand that statutory withdrawal rights may be lost after delivery begins, where law allows. Do not start checkout if you do not want immediate digital delivery.
9. Prohibited use
- Do not create misleading, counterfeit, infringing, fraudulent, unsafe, illegal, or deceptive listings.
- Do not upload private documents, payment cards, identity documents, explicit content, or content you do not have rights to use.
- Do not claim brand, authenticity, condition, model, working status, or value unless you can verify it.
- Do not bypass security, overload the service, scrape private areas, exploit bugs, resell access, or interfere with other users.
10. Availability and changes
SellPile may change, limit, suspend, discontinue, or update features, models, prompts, credits, packs, prices, or availability. The service may be unavailable because of maintenance, third-party outages, rate limits, payment issues, AI provider issues, or technical failures.
11. Disclaimers
To the maximum extent allowed by law, SellPile is provided “as is” and “as available.” We disclaim implied warranties, including merchantability, fitness for a particular purpose, non-infringement, accuracy, uninterrupted operation, and error-free operation. Some jurisdictions do not allow certain exclusions, so some wording may not apply to you.
12. Limitation of liability
To the maximum extent allowed by law, SellPile and its owners, operators, employees, contractors, and providers are not liable for lost profits, lost sales, lost data, business interruption, marketplace bans, buyer disputes, chargebacks, platform penalties, indirect damages, consequential damages, special damages, punitive damages, or reliance on SellPile output. To the maximum extent allowed by law, SellPile’s total liability for any claim is limited to the amount you paid to SellPile for the affected service in the three months before the claim.
Nothing in these Terms excludes or limits liability that cannot legally be excluded, including mandatory consumer rights, fraud, wilful misconduct, or liability for death or personal injury where such exclusion is not allowed by law.
13. Indemnity
You agree to defend and indemnify SellPile from claims, losses, costs, damages, penalties, and expenses arising from your listings, content, marketplace activity, buyer disputes, misuse of the service, breach of these Terms, violation of law, or infringement of third-party rights.
14. Refund policy
Refunds are governed by the Refund Policy. Buying digital credits or unlocking a plan does not automatically create a right to a refund after the digital result has been delivered, except where required by law.
15. Withdrawal, cancellation, and consumer rights
If mandatory consumer law gives you a right of withdrawal, cancellation, repair, price reduction, refund, or other remedy, those rights still apply. For digital content or digital services delivered immediately, your withdrawal rights may be lost or reduced after performance begins if you gave the required consent and acknowledgement before delivery, where law allows.
If you believe a paid digital result was not delivered or did not work because of a SellPile technical failure, contact support before filing a chargeback so we can investigate and, where appropriate, restore credits, re-run the result, or refund the eligible payment under the Refund Policy.
16. Governing law and disputes
These Terms are intended to be governed by the laws applicable to the SellPile operator, without limiting mandatory consumer protections that may apply where you live. Disputes should first be raised through SellPile support so we can try to resolve them informally.
EU consumers may have access to national consumer protection bodies or alternative dispute resolution bodies. The European Online Dispute Resolution platform has been discontinued by the European Union and should not be relied on as the dispute-submission channel.
